While the Flat Rock Creek Fall Festival welcomes everybody, including all attendees with disabilities, we only welcome assistance dogs as defined by Ohio Revised Code Section 955.011. A person with a disability that a service animal assists, or a personal care attendant who handles the animal for a person with a disability, is welcome. Any such individual will be requested as to what tasks or work the animal has been trained to perform in accordance with the Americans with Disabilities Act (“ADA”) regulations at 28CFR35.104. The work or task performed must be directly related to the individual’s disability.
In compliance with applicable law, the Flat Rock Creek Fall Festival generally allows service animals in the buildings, dining areas, recreational facilities, activities, and events so long as the service animal is accompanied by an individual with a disability who indicates the service animal is trained to provide and does provide, a specific service to them that is directly related to their disability.
The Flat Rock Creek Fall Festival will not permit service animals when the animal poses a substantial and direct threat to the health or safety of other attendees during the Flat Rock Creek Fall Festival.
Attendees and /or handlers are responsible for any damages or injuries caused by their service dog and must take appropriate precautions to prevent property damage or injury. The care and responsibility for the well-being of a service animal is the sole responsibility of the attendee and / or handler at all times.
Service dogs are different and separate, and are treated apart from “emotional support animals”. Under the Ohio Revised Code “assistance dogs or service dogs” are allowed to accompany people with disabilities into public accommodations. However, no Ohio Law covers “emotional support animals”.
Any individual wishing to attend the Flat Rock Creek Fall Festival with such an animal described as an “emotional support animal” will be required to present a letter authorizing the animal’s use by a duly licensed healthcare professional.
Without such a letter, no “emotional support animals” will be permitted on the Fair Ground Property during the Flat Rock Fall Festival. See Ohio Administrative Rule 3344-79-02, Ohio Administrative Code. See also, Americans with Disabilities Act 28CFR35.104
